Product liability law governs the liability of:
  • Manufacturers
  • Distributors
  • Suppliers
  • Retailers

Any product with some kind of defect may constitute as a defective product.  However, the law in Florida says that you may file a claim in scenarios including:
  • Manufacturing defect(s) – This means that the design of the product was safe, but picked up one or more defects during the manufacturing process of the product and became unsafe for a consumer.
  • Design defect – A product is defective by design if the designers or engineers made a plan to build a product that included a defect that they should have been aware would cause injuries to consumers.
  • Failure to warn – This is a defect in terms of the way a manufacturer instructs consumers to use their product or products.  If they correct use of the product may injure consumers and fails to mention this, it is negligence on the manufacturers behalf.
 
The goal of product liability laws is to help protect consumers from dangerous products, while holding manufacturers, distributors, retailers and suppliers responsible for  releasing dangerous or defective products into the marketplace that they know of should have known would cause injuries to consumers.

Having to deal with an injury caused by a defective product can be upsetting and an inconvenience to deal with, but when products cause injuries to children, it is particularly devastating.  Some of these injuries to children may be a result of:
  • Poisoning
  • Choking on small parts or toys
  • Shocks or burns from electronic toys or devices
  • Defective car seats
  • Crib and stroller injuries
  • Faulty or defective playground equipment

There are many defective products that can cause injuries to children. Since motor vehicle crashes are the leading cause of unintentional death in children who are 14 years or younger, we put our children’s safety first.  Therefore, we rely on car seats to protect our children in case of an unexpected crash with a negligent driver.  We as consumers and parents are persuaded into feeling safe when we use a name-brand child car seat and booster seat in our vehicles.
